Okay, so i have been living at my house for a year now, and i was living with this girl, and the electricity bill was under her name. when she moved out, i was going to start a new service under my name, but then when i called, the electricity company said that my room mate wasn't paying for anything and its now $2000 dollars, and in order to start service, we would have to pay for it, cause there is a disconnection notice. So i said, okay i didn't know she wasn't paying for it, so could i just pay half and start service. They said yes, all you have to do is send in your lease. So thats what i did, and then they transfer the whole dam balance over to my new account. I called and complained, and complained, and said that i never agreed to pay for the whole balance, and that everyone said i would only have to pay half, so now why did they do that? So what do you guys think? My roomate also just paid 200 on her account so now her money is just sitting there on her account.I have a problem and i need advice from a lawyer who can answer me correctly...?

Not a lawyer, but know something about basic contract law after taking two classes on it and I can tell you that when you use a service (such as electricity) you are creating a legally binding contract. There are implied in law contracts and implied in fact contracts that arise this way, and I am thinking this would be an implied in law contract - you used the service (the electricity) and now if you don't pay for it, you would unjustly be enriched at the expense of the electric company. So they can charge you the entire balance. However, if your roomate is making payments on her account for which the balance was transfered over to you, I would dig up any receipts I had to help explain that to them and take them in there and explain to them that if they transfered the balance from her account to yours, they also need to transfer any payments being made by her.
